Is it permissible to register on "Facebook" and accept the condition of arbitration by other than the law of Allah, which is mentioned in the agreement text: "You will resolve any claim, cause of action or dispute with us arising out of or relating to this Statement or Facebook exclusively in a state or federal court located in Santa Clara County, California. The laws of the State of California will govern this Statement, as well as any claim without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in Santa Clara County, California for the purpose of litigating all such claims"?

Allah Almighty has made it obligatory for the ruler to govern by His law, and has described rulings that contravene the Sharia as jahiliyyah (ignorance), and has conditioned faith upon recourse to the Sharia for judgment. It is permissible for a Muslim to seek judgment from man-made laws out of necessity and with conditions, such as the absence of Sharia courts, provided that he believes that Allah's ruling is superior, and that he does not deem lawful anything but what the Sharia has made lawful. Signing agreements that include a clause for recourse to man-made courts is permissible out of necessity and in the absence of a Sharia alternative, with the intention of not being content with invalid conditions.
