Marriage is not valid without a wali (guardian) and two just witnesses. The Quran and Sunnah stipulate the presence of a wali for the marriage contract to be concluded. A woman does not give herself in marriage, and whoever marries without the permission of her wali, her marriage is invalid.
If the conditions for marriage are met, there is no objection to marrying a man of a different nationality or one who is already married. If the wali prevents marriage to a suitable man without a legitimate shar'i (Islamic legal) justification, the woman has the right to refer her case to the judge to marry her off.
