The guardian is a condition for the validity of marriage, according to the majority of jurists. The father's abandonment of prayer does not invalidate his guardianship, according to many scholars. If his guardianship is invalidated by that, it transfers to the next in line or to the ruler.

If you both wish for the marriage to continue, the contract must be renewed in the correct manner, with the presence of your guardian and two witnesses. The documentation of the contract does not depend on its validity.

After the marriage is corrected, it is not permissible to refuse the husband access to his wife without a legitimate reason, nor to refuse to move with him if he wishes to move her from her country and he had not stipulated to her that she would not be moved.
