Is expiation (kaffarah) obligatory for the passenger accompanying the driver if two people died in a collision, especially if he was assisting him?

The expiation (kaffarah) is incumbent upon the driver of the car at the time of the accident, not his passenger. If the driver took all precautions and could not avoid the accident, then there is no expiation or blood money (diyah) upon him. However, if any condition of the precautions was neglected, then expiation is due from him and blood money from his 'aqilah (male relatives on the father's side). In the aforementioned truck accident, the driver is liable for two expiations if he was negligent, and his 'aqilah are liable for two blood monies. There is nothing upon his passenger unless he is one of the 'aqilah.
