What is the ruling on repeating the oath of divorce, "I divorce you by three from you" twice, then [saying], "You are divorced from me if I go with you to the doctor again, or if I ask you to go to the doctor," if the husband intends to prevent himself from doing the act and does not intend to effect a divorce?

The phrase "I divorce you by three, and you shall be divorced from me if I do such-and-such" contains four divorces: three intended and the fourth extra. The majority of scholars hold that a conditional divorce takes effect if the condition is met. Therefore, if the husband goes with his wife to the doctor or requests it, a triple divorce occurs, and she becomes irrevocably divorced from him until she marries another man. However, if the husband did not intend divorce but merely sought to restrain himself, Ibn Taymiyyah holds that an expiation for an oath is required. The fatwa points out that the husband's intention determines the oath: if his intention was for a specific period and that period elapsed before the act, then no divorce occurs.
