A wife is divorced when the condition upon which the divorce is suspended is met, whether the husband intended divorce, threat, affirmation, or prevention. This is the view of the majority of scholars. Shaykh al-Islam Ibn Taymiyyah, however, holds that suspending a divorce on a condition with the intention of threat does not effect the divorce, and its ruling is that of an oath. Based on this, if the wife has been divorced thrice, she is irrevocably divorced (baynunah kubra), and she cannot return to her husband unless she marries another husband in a marriage of desire, he consummates the marriage with her, and then he divorces her or dies, and her 'iddah (waiting period) from him expires. There is no blame on someone who acts upon the saying of some scholars in matters of differing opinions, as long as they are comfortable with that saying.
