If a man swears an oath of divorce three times and then breaks it, the divorce is effective according to the majority of scholars, whether it was uttered in a single phrase or on multiple occasions, and whether it was a conditional divorce (ta'liq) or a threat. Ibn Taymiyyah holds that a threefold divorce pronounced in a single phrase counts as a single divorce, and that a divorce intended as a mere threat does not take effect. Based on the opinion of the majority, the woman becomes unlawful to her husband through a major irrevocable divorce (baynunah kubra); she does not become permissible for him again until she marries another man and he separates from her. Any sexual intercourse before that is considered adultery. It is necessary to refer such matters to the Sharia court.
