Custody is obligatory by scholarly consensus, and the mother has the most right to it due to her compassion, but she cannot be compelled to undertake it unless the marital relationship is ongoing. A disabled child is most in need of care and love, and it is forbidden to make him feel ridiculed. There is no sin in appointing a maid to care for him, as long as she is good, a Muslim, possesses religiosity and good character, and is regularly supervised.
