Do children inherit their father's money acquired through unlawful means?
Scholars have differed regarding the ruling on an heir possessing unlawful wealth acquired by their deceased predecessor through illicit means. The preponderant opinion is that it is not permissible for the heir to take it, whether its owner is known or unknown, for death does not render unlawful wealth permissible. If the true owner of the wealth is known, it must be returned to him. However, if the owner is unknown, such as usurious funds or bribes, the wealth reverts to its original owner, who is Allah Almighty, and should be disbursed to the poor as charity. If the heirs themselves are poor, it is permissible for them to take from it as charity, not as inheritance.
