The basic principle is that a person's ownership does not transfer to another except by a legitimate legal reason. Accordingly:
- The land of the deceased father remains part of his estate, even if his children used it by his command.
- The land gifted to the brother by his grandfather, if it was taken possession of during the grandfather's lifetime, is the exclusive property of the brother to whom it was gifted, and it does not enter into the father's estate, even if the father planted trees on it.
