If the loan is without usurious interest, Zakat on it is obligatory if it reaches the nisab and a year has passed over it after deducting the debt; otherwise, there is no Zakat on it. However, if the loan is with usurious interest, it is forbidden and repentance from it is necessary. Not every necessity permits consuming what is unlawful, except for a necessity similar to that which permits eating carrion. Money acquired through a corrupt and forbidden contract does not convey ownership nor permit its use, and it requires mutual restitution from both sides. If the money is still with the borrower, he must return it to the bank, and he is not obligated to pay its interest. If he is compelled to pay it, then he should pay it.
