What the husband utters as a subtle, allusive conditional divorce, according to the Malikis, its ruling depends on his intention. If he did not intend divorce, then nothing is incumbent upon him; but if he did intend it, then it becomes binding. This conditional divorce takes effect according to the Malikis if the condition upon which it is suspended occurs. So, if the sister does not marry the man whom the husband disapproves of, then no divorce occurs. But if she does marry him, then the matter reverts to the husband's intention: if he did not intend divorce, then nothing is incumbent upon him; but if he did intend it, then it becomes binding.
