Does a divorce take effect if one says, "I swear by Allah Almighty, if you speak about this matter a second time, it will be the last thing between you and me," and then, after the wife speaks, it is said, "The divorce has taken effect," even though the intention was to prevent the wife from speaking and not to divorce her?

The phrase "I swear by Allah the Almighty, if you speak on this matter a second time, it will be the last thing between you and me" is not an explicit divorce (talaq (definition) sareeh). Rather, it is one of the ambiguous phrases (kinayat) by which divorce does not occur unless the husband intends it. So, if the intention of divorce was not present, divorce does not occur. However, if the intention was present, then a single divorce occurs upon the happening of the action upon which it was conditioned. If the husband doubts his intention for divorce, the default is that it has not occurred.
