The question

Is what was mentioned concerning the verbalization or writing regarding the suspension of my divorce upon my marriage to a specific girl considered a valid suspension of divorce, bearing in mind that I suffer from severe obsessive thoughts concerning this matter, and can I adopt the view of the Shafi’i school that it is void if its occurrence is presumed, even if my marriage will be conducted according to the Hanafi school, and can Fatwa No. 102665 be beneficial in my case?

The answer

It is clear that the matter is merely a case of obsessive thoughts. Even if you made the divorce of the wife conditional upon marrying her, this has no effect on the marital bond for several reasons:

1. Divorce does not occur before marriage. 2. Stipulating in the marriage contract that it adheres to a specific (school of thought) does not obligate you to follow that madhhab in all issues. 3. Divorce does not occur with doubt. 4. Divorce issued due to obsessive thoughts is not valid.

Know that merely mentioning divorce by way of narration or asking a question does not constitute divorce. Therefore, disregard these obsessive thoughts, proceed with your marriage, seek help from Allah, and consult a psychiatrist.
