What is the ruling regarding a man divorcing his wife by saying: "I have released you," intending divorce, followed by the wife saying: "I am going to my father's house again after this, and if I go, you are divorced by three (talāqs)"? And how many divorces occur in this case?

If a man says to his wife, "I have released you" (sarraḥtuki), and he intends divorce, then divorce occurs with it, and it is a single divorce unless he intends more. As for conditioning a triple divorce on her going to her father's house, the fatwa among us is that it occurs as a triple divorce if she goes. Some scholars hold the view that if he intended a threat and did not intend to effect a divorce, then divorce does not occur, and the husband is liable for an expiation for breaking an oath (kaffārat yamīn). It is advisable to present the matter directly to scholars.
