The question

What is the ruling on the money that was handed to the wife in front of the investigator after the husband acknowledged that it was her money and her children's money, and she is still spending from it on herself, her children, and the rent of the accommodation, given the ongoing appeal of the Khulʿ and custody rulings, and the fact that the husband is in prison and she has no provider?

The answer

Issues involving disputes and contentions are not resolved by fatwas; rather, they are referred to the judiciary, which has jurisdiction. Generally, the wife's maintenance is obligatory upon the husband as long as she is under his marital care, and likewise, the children's maintenance. The waiting period () for a divorce issued by the court does not begin until the ruling becomes final. Whatever the wife spent from her husband's money, in a reasonable manner, on herself and the children, there is no blame in that. However, if a final Khul' (dissolution of marriage) ruling is issued, the husband is not obligated to provide maintenance for his divorced wife, but he is obligated to provide maintenance for his children.
