If a wife requests divorce due to harm, is she obliged to return any portion of her dowry?
Source: FtawySummary from Ftawy's records · added here Sep 2, 2026
The husband is obligated to treat his wife well and not harm her. The wife has the right to request a divorce due to severe beating or other valid reasons for divorce. If this is proven to the judge, he will rule for her divorce without compensation. If he does not harm her with a harm that permits her to seek divorce, but she dislikes staying with him, then she may request separation from him through divorce or khul' (divorce at the wife's instance) in return for all or part of her dower, or a sum of money they agree upon.
