Is it permissible to marry another woman before officially divorcing the first wife, knowing that there has been a divorce case pending for three years?
Source: FtawySummary from Ftawy's records · added here Sep 2, 2026
A husband may marry another woman while the first wife remains under his marital bond, without informing the second wife of his marital status, because polygyny is permissible with its Shariah-compliant conditions. If he needs to inform her, he may resort to tawriyah (deliberately ambiguous speech), such as saying, "I am separated from my wife," intending physical separation or future separation. He is not permitted to lie explicitly.
