It is not permissible for a woman to seek khul' (divorce at the wife's instance) without a valid reason, unless she dislikes her husband and fears that she will not fulfill Allah's rights with him, in which case it is permissible for her. The general principle for khul' is that it should occur with the husband's consent, but if the husband refuses and the wife is being harmed, the judge may compel him to grant the khul'. Scholars have differed on whether khul' is a divorce (talaq) or an annulment (). According to the view that it is a divorce, the wife becomes irrevocably divorced (baynunah kubra). According to the view that it is an annulment, it is not counted as a pronouncement of divorce. It is preferable for the husband to take his wife back, and if she desires khul' without a valid reason, he has the right to refuse.
