What is the waiting period (iddah) for a girl who stayed in her husband's house for more than twenty days, and there was a lawful seclusion (khalwah shar'iyyah) between them, then she returned to her father's house and was divorced, and she married two weeks after her divorce? And what is the validity of her second marriage if she was still in her waiting period (iddah)?

The divorced wife must observe the 'iddah (definition) (waiting period) if a valid seclusion (khalwah shar'iyyah) occurred between her and her husband, and this is the view of the majority of scholars. The wife's admission that her husband did not touch her does not waive the 'iddah for her, even if the husband believes her. If a woman in 'iddah marries before the completion of her waiting period, her marriage is void. Separation between her and the second husband becomes obligatory, then she must complete the 'iddah of the first husband, and then observe the 'iddah from the second husband. Furthermore, a wife is considered defiant (nashiz) if she leaves her husband's house without his permission and refuses to return.
