Why are spouses not reminded of their right to divorce or annulment (khulʿ), instead of being urged only to be patient, even if one of the parties is a believer?

The answer

We emphasize patience and striving for reconciliation, because although divorce and khul' are permissible, the greater good may lie in patience, especially when there are children or other circumstances. This is in accordance with His Almighty's saying: "And reconciliation is better," and His saying: "And if you dislike them, it may be that you dislike a thing and Allah makes therein much good." We always mention the right to divorce and khul' as legitimate solutions when needed, while emphasizing the importance of seeking the better of the two options: patience or separation, in addition to the importance of good character and kind treatment between spouses.
