If a man divorces his wife before consummating the marriage, he cannot take her back, because reconciliation (raj'ah) occurs during the waiting period (), and a woman divorced before consummation is not required to observe an iddah, based on the Almighty's saying: (O YOU WHO HAVE BELIEVED, WHEN YOU MARRY BELIEVING WOMEN AND THEN DIVORCE THEM BEFORE YOU HAVE TOUCHED THEM, THEN THERE IS NOT FOR YOU ANY WAITING PERIOD TO COUNT CONCERNING THEM). If the former husband wishes to take her back, he must enter into a new marriage contract with her, along with a new mahr.
