If the husband intended to effect a khulʿ (divorce initiated by the wife in return for compensation) by a message "I have received the amount, and the khulʿ is done," then the khulʿ is effected, even if it was without compensation. Al-Kharashi said: Khulʿ is valid even without compensation. If the husband had not divorced you twice before, then you have become irrevocably divorced from him with a minor separation (baynunah sughra), and you cannot return to him except with a new contract that fulfills the known conditions of marriage, which are: the guardian (wali), the dower (mahr), and two witnesses.
