Is it permissible for a man who was forced into marriage by his parents to seek annulment of the contract?
If a man is forced into marriage, the validity of his marriage is subject to detail:
1. If the compulsion reaches the level of duress (such as threats of killing or imprisonment), the marriage is invalid by consensus. 2. If the compulsion is merely persistence and insistence from the parents, and does not reach the level of duress, then the marriage is valid; because the man has the right to refuse, and the contract is not concluded except by his choice, and he has no guardian in marriage. In this case, the man has no right to annulment; because he possesses the right to divorce.
This differs from a woman, for her contract is concluded by her guardian, and if she is forced to marry someone she dislikes, she has the option to proceed or annul, as stated in the of Buraydah ibn al-Husayb.
