Is it permissible for a woman to marry with the intention of temporary marriage (mut'ah) during a period when her husband has abandoned her, fearing falling into sin, and would this marriage be considered a sin, and is it permissible for her to return to her original husband with a new contract if his treatment improves?

A wife should try to reconcile with her husband and involve people of goodwill. She is not permitted to seek a divorce except out of necessity. A husband's abandonment of his wife does not signify marital separation, as she remains under his legal guardianship, and she is not permitted to marry another man. Mut'ah marriage (temporary marriage) is invalid and abrogated; it is considered zina (fornication/adultery). Whoever commits it must repent, cease the act, seek forgiveness, and conceal what has occurred. Nothing is required for the wife to return to her husband because he is still her husband; however, she must observe a period of iddah (definition) (waiting period) to ensure she is not pregnant.
