Witnessing the marriage contract is one of its pillars. The majority of scholars hold that the witnessing of two just men at the time of the contract is obligatory. If the contract is not concluded in the presence of two just witnesses, neither of whom is the woman's guardian, then it is invalid. There is no harm in the presence of two brothers of yours or of the woman, provided that neither of them is her guardian in the contract.
