Is it permissible to marry a mature woman remotely, and to make her dowry lawful, and what is its amount, and how is it paid, and to whom is it paid?
A lawful marriage has conditions and pillars, including the guardian (wali) and witnesses. It is not valid without the offer from the guardian and the acceptance from the husband, in the presence of two witnesses. If the guardian or the husband is in another country, each of them may appoint a representative on their behalf.
As for conducting a marriage contract through modern communication methods (remotely), scholars have differed on this matter. Many contemporary scholars deem it invalid, and the Islamic Fiqh Academy has issued a decision to this effect.
The determination of the dowry (sadaq) and the manner of its قبض (receipt) is by agreement of the two mature spouses, and it is paid to the wife or her appointed representative.
