After the marriage contract, divorce can only be obtained through the husband's pronouncement of divorce or by his agent, or by a judge's ruling, or by khul' (divorce at the wife's instance) before a judge.
Divorce is the right of the husband, but a woman has the right to request divorce from a judge for specific reasons, such as the husband's absence, his inability to provide maintenance, or his ill-treatment. In such cases, the judge rules on the divorce. It is also permissible to agree upon separation without the need for a judicial process. This is based on the noble verse: (O you who have believed, when you marry believing women and then divorce them), and the : (Indeed, divorce is for him who grasps the leg [i.e., the husband]).
Therefore, you are not permitted to marry or become engaged before the divorce is finalized.
If divorce occurs before consummation, the wife is entitled to half of the mahr (dower), based on His Almighty's saying: (And if you divorce them before you have touched them but you have already specified for them an obligation, then [give] half of what you specified).
