Is it permissible to perform the marriage contract without celebrations three months after the death of the bride's father, while her mother's 'iddah has not yet ended?
It is permissible to conclude a marriage contract with a girl even if her mother is observing the ' (waiting period) for widowhood, as there is no legal impediment to that. The contract does not require expressions of joy; the presence of the guardian and two witnesses is sufficient. However, the feelings of the girl and her family should be considered. If this does not harm them or diminish their joy, then there is no objection. Otherwise, the contract should be postponed until their grief subsides and the mother is able to adorn herself if she wishes, keeping in mind that a woman observing 'iddah does not adorn herself. In summary, there is no legal impediment to concluding the contract in this situation if the girl and her family agree and it does not cause them harm.
