Is marriage permissible after reciting the Fatiha and with the consent of both parties and the guardian, but before the marriage contract? Is sexual intercourse in this situation considered permissible or forbidden, and what are the implications if it is forbidden?

For a legitimate Islamic marriage contract (aqd) to be valid, certain conditions must be met, such as the offer (ijab) and acceptance (qabul) between the two parties, and the testimony of two upright witnesses. Merely reciting Al-Fatiha and making supplications does not constitute a valid Islamic contract. Sexual intercourse with a woman in such a case is considered zina (fornication/adultery), which necessitates repentance. Engaging in sexual intercourse before consulting scholars is a negligence unacceptable from a Muslim.
