A marriage contract is not dissolved except by certainty, such as divorce or khul‘ (divorce at the wife's instance with compensation), and certainty is not removed by doubt. Divorce does not occur except by an explicit pronouncement or an implicit one accompanied by intention. If the husband was not aware of the delegation (of the right to divorce), then he has not delegated anything. The husband's revocation of the delegation is accepted by a group of scholars. Your continued stay with your husband for a period indicates that the delegation was not acted upon and is therefore void. A wife allowing her husband sexual access nullifies the delegation of divorce.
