What is the ruling on a marriage that was conducted secretly without the presence of the bride's guardian (wali), after her elder brother refused it? And what should be done regarding this marriage?
Source: FtawySummary from Ftawy's records · added here Sep 2, 2026
Marrying without consulting the people of knowledge regarding its ruling is a dereliction and a leniency, especially when it concerns private parts. A marriage contracted without a guardian (wali) and witnesses is invalid and must be annulled. If you both wish to continue, the legitimate contract must be renewed with the presence of the guardian and witnesses. If the guardian refuses to marry her off without a legitimate reason, she may refer the matter to the judge to marry her.
