A marriage () conducted without the presence of the woman's guardian (Wali) is invalid according to the majority of scholars, but it is valid according to Abu Hanifa, and it can be upheld by the ruling of a judge or by adhering to his (school of thought). Conditions that negate the wife's legal rights are void, but the marriage itself remains valid, as rights are established simply by the contract. Marrying more than four women is invalid by scholarly consensus. Nikah requires the fulfillment of its pillars and the acceptance of both parties. Publicizing it is desirable but not a pillar, nor is it a condition for its validity to be documented in court. Mentioning the dowry (Mahr) is neither a pillar nor a condition for the validity of the Nikah.
