Is a woman entitled to claim her deferred dower upon divorce, even if she did not desire the divorce and had previously pledged to waive it, and what are her rights after divorce if there are no children between the spouses?

The preponderant view is that a promise which entails the promised party incurring a burden must be fulfilled, unless there is an excuse. This is the of the Malikis and a group of scholars. Therefore, a wife's promise to her husband not to demand the deferred mahr must be fulfilled, because she stated the reason and the husband would incur a burden by not fulfilling it.
