What is the legal ruling on a husband abandoning his wife, and what are the consequences of her seeking divorce and leaving the marital home, and what is the ruling on maintenance for a five-year-old child in her custody?
Source: FtawySummary from Ftawy's records · added here Sep 2, 2026
The maintenance of a wife who is not disobedient (nashiz) is obligatory upon her husband according to what is customary, and it is not waived from him except upon the expiration of her ' (waiting period). The maintenance of the child is incumbent upon him as long as the child is in need. A husband abandoning his wife without justification is an injustice that permits her to seek divorce. It is not permissible for the wife to leave her husband's home after a revocable divorce except out of necessity.
