The question

What is the ruling on one who swore by triple divorce that a colleague would not work with him in his shop, then he himself left the shop? And does divorce take effect in a state of anger? And is it counted as one divorce or three? And what are the consequences of that?

The answer

Whoever swears an oath of divorce intending its occurrence, it takes effect upon breaking the oath. If it was uttered in a state of anger, there is a detailed explanation for that. As for someone who swears by divorce not intending divorce, but rather to urge or prevent something, then an expiation for an oath (kaffarat ) is required upon breaking the oath, and the divorce does not occur. The triple divorce counts as a single divorce, according to the preponderant opinion. If you intended divorce with your words and your anger did not prevent its occurrence, then a single divorce has occurred, with both of you remaining in the same place. Otherwise, nothing is binding upon you. It is obligatory to avoid using divorce in an inappropriate context.
