What is incumbent upon a man who said to his wife, "You are forbidden to me like my mother," then had sexual intercourse with her and begot children from her, and did not expiate for his oath, and he possesses no wealth nor is he able to fast for two consecutive months, and he has repented and sought Allah's forgiveness?

Dhira (abusive assimilation of wife to mother) is a forbidden and reprehensible statement, and it necessitates a severe expiation (kaffara mughalladha), which is: freeing a believing slave. If one is unable to do that, then fasting for two consecutive months. If one is unable to do that, then feeding sixty poor persons. It is not permissible for a man to have intercourse with his wife until after performing the expiation. If he has intercourse with her before the expiation, the expiation does not lapse or multiply; rather, the same expiation remains binding upon him, along with repentance and refraining from intercourse until he expiates. The expiation is waived if there is complete inability to perform any of its forms. If the man is unable to fast due to illness or old age, but he is able to feed sixty poor persons, then he must do so, by feeding each poor person a meal or giving him enough food (e.g., one kilogram of rice with what accompanies it). It is not permissible to give the expiation to a single poor person or to fewer than the specified number.
