Will the husband be sinful for not providing for his wife who refuses to travel to him and demands a divorce after discovering she is afflicted with magic, and is the wife entitled to all her rights if she insists on divorce, even though the husband does not wish to divorce her?
If a wife leaves her husband's home without his permission, or refuses to travel with him, she is considered disobedient (nashiz). Her family's refusal to allow her to travel with him does not constitute obedience, as the husband has more authority over her than her parents, and obedience to him is more incumbent. Since she is disobedient, she is not entitled to maintenance. If she requests a divorce without a valid reason, the husband may refuse to divorce her until she waives some of her financial rights. An exception to this is if the husband has an illness that prevents conjugal relations with his wife; in this case, she has the right to annul the marriage. It is advisable for family intervention to reconcile the spouses and to seek treatment for the wife from the symptoms of sorcery that have appeared on her.
