Does the accident that resulted in the death of the mother and brother, coupled with stress, distraction, and a claim of inability to fast, necessitate expiation?

Traffic accidents are considered accidental killing (manslaughter). If the driver is deemed responsible, two things are incumbent upon him: First, expiation (kaffarah (definition)), which is the freeing of a slave. If one cannot find a slave, then it is fasting for two consecutive months. And whoever is unable to do that waits until he is able to fast; he does not feed the poor. Second, a reduced blood money (diyyah) payable by the 'aqilah (the male relatives on the father's side).
