Is it permissible to obtain Tawaruq from Banque Saudi Fransi to build a private residence, given that the agreement between the questioner's company and the bank is based on the bank's Tawaruq transaction for metals it owns in warehouses, and the client authorizes the bank to dispose of and sell them, in exchange for mortgaging the land to the bank?

The transaction mentioned, if it is of the organized Tawarruq type, is not permissible, unless its subject is a commodity that the Mustawriq (the one seeking cash) can acquire and undertakes to sell himself. The mortgage does not affect the validity of the transaction. However, if the bank arranges the sale of the commodity to the Mustawriq at a deferred price, and then the bank undertakes to sell it on his behalf to another buyer at an immediate price, this is not permissible.
