The answer

None of the adult children have guardianship over minors or over other adults like themselves. Rather, guardianship is established either by the will of the deceased or by court order. It is not permissible to withhold any part of the inheritance for the education or marriage of some heirs. Instead, the inheritance must be divided, and each heir receives their lawful share. In case of dispute among the heirs regarding the inheritance, the matter must be referred to the court or to qualified scholars (mashayikh) who are competent to judge.
