The answer

If the bank, of its own volition, waives the debt of the deceased, then his liability is discharged, and the bank's insurance with insurance companies does not affect this. However, if the debtor was the one who insured himself, then if the insurance company is a Takaful (Islamic cooperative insurance) company and it pays off the debt on behalf of the deceased, his liability is discharged. But if the insurance company is a commercial one, then it is not permissible to insure with it in the first place. If such a thing occurs, it is not lawful for the bank to take from the insurance company more than what the debtor paid as a premium, otherwise it would be taking money unjustly.
