Is the 9% annual legal interest, ruled in a case of outstanding dues, permissible, and is it permissible to cover a portion of the lawyer's fees and litigation expenses from it if it is impermissible?
Source: FtawySummary from Ftawy's records · added here Sep 2, 2026
It is permissible to file a lawsuit to claim a right, even before a secular court, provided that one does not exceed the right. The one who procrastinates in fulfilling a right is obliged to pay the lawyer's fees and litigation expenses, because the procrastinator who unjustly causes the fine bears it. However, it is not permissible to take interest resulting from the delay, because it is usury.
