There is no harm in cutting tree leaves for benefit, such as for fragrance, even if the trees are within the of the mosque or its vicinity, because this is something people are lenient about. The majority of scholars permit taking leaves from trees in the Meccan Haram by hand, as long as it does not harm the tree. This is the view of the Shafi'is, Hanafis, and Malikis. As for the Hanbalis, they do not permit cutting leaves from trees in the Haram. The consistent prevalence of custom, by way of leniency in this matter, takes the place of the endower's permission if the trees were endowed.
