Uttering the intention is not legislated; its place is the heart. The is valid because scholars differed concerning water used in obligatory purification. Some said it is pure and purifying (ṭahūr), while others said it is pure (ṭāhir) but not purifying. According to the second opinion, used water does not lose its purifying quality if a small amount falls into purifying water, due to the difficulty of avoiding it and the widespread affliction.
