Is it permissible to take from the money of the mendicant maternal aunt who donated a portion of her house to my mother, and lives in a portion of it, and rents out the larger portion?

Asking [for charity] without need is reprehensible in Islamic law, except for three [types of individuals]: a man who bears a heavy financial responsibility [for others] until he obtains [the means to fulfill] it, and then he stops; a man whose wealth has been swept away by a disaster until he obtains a sustenance for living; and a man who has been afflicted by destitution until three people from his community testify that he has been afflicted by destitution, until he obtains a sustenance for living. Anything other than that is unlawful gain (suht). The questioner should advise the woman to refrain from asking [for charity] except out of necessity. As for her gifting her house or money to her mother or anyone else, it is considered a valid gift if its conditions are met.
