The question

Is the ruling on halving a woman's blood money for killing and for lesser injuries, whether this halving is based on the Hadith of Mu'adh ibn Jabal or from the book of Amr ibn Hazm, a fixed legitimate ruling by a Quranic and Sunnah text that accepts no discussion or ijtihad, or is it a jurisprudential opinion or a later ijtihad, taking into account the generality of the noble verse: "And whoever kills a believer by mistake, then (he must free) a believing slave and pay a blood money handed over to his family" (An-Nisa 4/92), as well as considering the opinion of contemporary scholars and the changing realities?

The answer

The blood money (diyya) for a woman is half that of a man, and this is a matter on which there is scholarly consensus (ijma'). This consensus has been reported by Ibn al-Mundhir, al-Shafi'i, and others. Consensus is considered the third source of legislation, and its authority is established by Qur'anic and prophetic evidence, including the Almighty's saying: "And whoever opposes the Messenger after guidance has become clear to him and follows other than the way of the believers - We will give him what he has taken and drive him into Hell, and evil it is as a destination," and the Prophet's (peace be upon him) saying: "This Ummah will not agree upon error."
