My wife in Egypt wants to buy a car for necessities, and I work in Saudi Arabia and do not have its price. Is it permissible to take a loan from the Saudi National Bank, given that the sale and purchase are completed within 24-48 hours, especially since the Saudi Dar Al-Iftaa (House of Fatwas) has approved it and stated that it is permissible? And if the loan is impermissible, and I am unaware of it, will the sin be upon the Dar Al-Iftaa?
All praise is due to Allah, and prayers and peace be upon the Messenger of Allah, and upon his family and companions. To proceed:
It is permissible for the bank to purchase the goods and take possession of them, then sell them for a higher price on installments. This can be completed within 24 or 48 hours, provided that possession is taken before the sale. However, if possession is not taken, the sale is invalid, as the Prophet (peace be upon him) forbade selling goods before possessing them.
It is not permissible to take a loan in the manner described because it involves selling goods before taking possession of them. If a layperson relies on the of a trusted scholar and the invalidity of the fatwa is not clear to them, then there is no sin upon them.
Legitimate authorities may issue a correct fatwa, but the banking transaction might proceed in a different direction during implementation, so one must be careful about that.
And Allah knows best.
