The question

Does divorce occur by saying "You are divorced" via a mobile text message with the intention of discipline, not with the intention of effecting a divorce? What is its legal ruling in the event that it occurs, and how can the wife be taken back?

The answer

Divorce via a text message is considered a divorce by implication (kinayah) and does not take effect unless there is an intention to divorce. So, if you did not intend divorce but rather to discipline your wife, then the divorce does not take effect, and it is not counted as a pronouncement of divorce. Consequently, there is no need to review her, as the divorce did not originally occur. It should be noted that divorce during menstruation is effective according to the majority of scholars, and the husband is sinful if he intentionally pronounces it at that time.
