Is it permissible to exchange privately owned land for land owned by the Awqaf (religious endowments)?
Source: FtawySummary from Ftawy's records · added here Sep 2, 2026
The fundamental principle is that an endowment (waqf) cannot be sold, gifted, or inherited, based on Umar's in the Two Sahihs: "Its origin is neither sold nor bought, neither inherited nor gifted." An exception to this is when necessity dictates its sale or replacement, such as when it is no longer fit for its intended purpose, or there is fear for its preservation, or for a recognized benefit. In such cases, its supervisor is permitted to sell, purchase, or replace it.
